Terms of Service

Welcome to GoGifte. These Terms of Service ("Terms") explain the rules for using GoGifte and what you can expect from us. We've written them as plainly as we can — please read them, because using GoGifte means you agree to them.

1. Acceptance of Terms

By accessing or using GoGifte — including our website, AI Gift Assistant, and any related features (together, the "Services") — you agree to these Terms and to our Privacy Policy and Cookie Policy. If you don't agree, please don't use the Services. If you're using GoGifte on behalf of an organisation, you confirm you're authorised to accept these Terms for it.

2. Use License

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose: discovering and giving thoughtful gifts.

You may:

• Browse recommendations, use the AI Gift Assistant, save ideas, and follow links to merchants.
• Share GoGifte links and content in the ways our features allow.

You may not:

• Scrape, harvest, or bulk-download content except as permitted by our robots policy.
• Reverse-engineer, resell, or commercially exploit the Services or their output without our written permission.
• Interfere with the Services, probe for vulnerabilities outside a responsible-disclosure context, or bypass security or rate limits.
• Use the Services to break the law, infringe rights, or harm others.

3. Marketplace Rules

GoGifte connects gift-givers with third-party merchants. We surface products and route you to merchants; the merchant is the seller of record.

• Merchant rules. Merchants must meet the standards in our Merchant Terms, including accurate listings and honest fulfilment. Merchants — not GoGifte — are responsible for their products, pricing, and shipping.
• User conduct. Be honest and respectful. Don't submit false information, manipulate rankings or reviews, or misuse another person's account.
• Content rules. Anything you submit (reviews, messages, saved lists) must be lawful, truthful, and free of hateful, deceptive, or infringing material.

4. Intellectual Property

The Services, including our name, logo, design, and original content, are owned by GoGifte or our licensors and protected by intellectual-property laws. Product information and imagery may belong to merchants or brands and are used with permission or under applicable law. Nothing in these Terms transfers ownership to you beyond the limited licence in Section 2.

5. User Content Liability

You keep ownership of content you submit, but you grant GoGifte a worldwide, royalty-free licence to host, display, and use it to operate and improve the Services. You're responsible for what you submit and confirm you have the rights to share it. We may remove content that breaks these Terms, but we don't pre-screen everything and aren't liable for user-submitted content.

6. Disclaimer of Warranties

The Services are provided "as is" and "as available." GoGifte is a gifting advisor, not the seller. Recommendations are suggestions made in good faith to help you decide — they are not guarantees about a product's suitability, availability, price, or a merchant's performance. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, GoGifte and its team won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Where liability can't be excluded, our total liability is limited to the greater of the amount you paid us (if any) in the 12 months before the claim, or USD 100. Purchases are made from merchants; disputes about a product are primarily between you and that merchant, though we'll help where we can.

8. Indemnification

You agree to indemnify and hold GoGifte harmless from claims, losses, and reasonable costs arising from your misuse of the Services, your content, or your breach of these Terms or of applicable law.

9. Modification of Terms

We may update these Terms as GoGifte evolves. When we make material changes, we'll update the "last updated" date and, where appropriate, give notice through the Services. Continued use after changes take effect means you accept the updated Terms. Prior versions are tracked internally as content assets so changes are auditable.

10. Termination

You may stop using GoGifte at any time. We may suspend or end your access if you break these Terms or create risk for others or the Services. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which GoGifte is established, without regard to conflict-of-law rules. Where a dispute can't be resolved informally, it will be handled by the competent courts of that jurisdiction, unless applicable consumer-protection law gives you the right to bring it elsewhere.
